Terms of Service

These Terms of Service ("Terms") govern your access to and use of Pet Portrait (the "Service"), including our mobile app and any related features. By using the Service, you agree to these Terms.
If you do not agree, do not use the Service.
1) Who we are

2) The Service
Pet Portrait lets you upload a pet photo, generate an AI-stylized portrait, and optionally order a physical print (e.g., poster or canvas). Orders are paid via our payment provider and fulfilled by print and shipping partners.
3) Eligibility and accounts
You may use the Service without creating a traditional account. We may use anonymous identifiers/sessions to operate the Service (for example, to associate an order with your device/session).
You must use the Service lawfully and in accordance with these Terms.
4) Orders, pricing, and payment
Prices
All prices shown in the app are inclusive of VAT (where applicable) unless stated otherwise.
Payment
Payments are processed by Stripe or another payment provider we may use from time to time. You authorize us (and our payment provider) to charge the payment method you provide for your order.
We do not store your full card details.
Order confirmation
An order is considered placed once payment is successfully completed and you receive an in-app confirmation and/or confirmation message.
5) Shipping and delivery (estimated)
Production and delivery times shown in the app are estimates. We work with fulfillment partners to manufacture and ship products, and delivery times can vary due to carrier delays, address issues, peak demand, customs (where applicable), and other factors outside our control.
We are not responsible for delays caused by carriers or circumstances beyond our reasonable control, but we will do our best to help you resolve delivery issues.
6) Personalized products and cancellation (important)
Our prints are made to order based on your uploaded content and selected options. Because the products are personalized, your legal right of withdrawal/cancellation may be excluded for these items (e.g., under applicable consumer law for personalized goods).
If something arrives damaged or defective, see Section 7.
7) Damaged, defective, or incorrect orders ("Customer is king")
If your order arrives damaged, defective, or materially different from what you ordered, contact us at privacy@checkurchat.app and include:
- your order identifier (if available),
- a short description of the issue,
- and clear photos of the product and packaging.
When appropriate, we will work with you to make it right - typically by reprinting the item or refunding you, depending on the situation.
8) Your content and permissions
Your uploads
You retain any rights you have in the photos you upload ("User Content"). You confirm you have the right to upload and use that content (for example, you own the photo or have permission).
License to operate the Service
To provide the Service, you grant us a limited, non-exclusive, worldwide license to host, process, reproduce, and display your User Content and generated portraits only as needed to:
- generate your portrait,
- display it in the app,
- fulfill print orders,
- provide customer support,
- and operate and improve reliability of the Service.
This license ends when your content is deleted from our systems, except where we must retain certain records for legal or operational reasons (e.g., order records).
AI outputs
The portrait generated by the Service is an AI-created stylization ("Output"). You may use the Output for personal use. If you plan to use it commercially (e.g., branding, resale, ads), you are responsible for ensuring you have the necessary rights in the underlying content and that your use complies with applicable law.
9) Content guidelines (lightweight, MVP)
We don't proactively review every upload. However, you agree not to use the Service to upload or generate content that is unlawful, violates third-party rights, or is abusive (e.g., harassment, exploitation, or illegal content). We may refuse processing, remove content, or suspend access if we believe content or usage violates these Terms or creates legal or safety risk.
10) Acceptable use
You agree not to:
- interfere with or disrupt the Service,
- attempt to access systems or data you are not authorized to access,
- use automated means to scrape or overload the Service,
- reverse engineer or attempt to extract model/system prompts or internal logic where prohibited by law.
11) Intellectual property
The Service (including the app, branding, UI, and underlying software) is owned by us and protected by intellectual property laws. These Terms do not grant you rights to our trademarks, brand features, or software beyond the limited right to use the Service.
12) Disclaimers (AI is weird)
The Service is provided "as is" and "as available." We work hard to produce great results, but AI outputs can be unpredictable. We do not guarantee that every Output will perfectly match expectations or be free from artifacts.
Nothing in these Terms limits mandatory consumer rights that cannot be waived under applicable law.
13) Limitation of liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenues, or data.
- Our total liability for any claim relating to the Service or an order is limited to the amount you paid for the relevant order.
This limitation does not apply to liability that cannot be limited under German law (e.g., intent, gross negligence, injury to life/body/health, or mandatory product liability rules).
14) Changes to the Service and Terms
We may update the Service and these Terms from time to time. If we make material changes, we will update the "Last updated" date and may provide additional notice within the app.
Your continued use of the Service after changes become effective means you accept the updated Terms.
15) Governing law and jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany.
If you are a consumer, mandatory consumer protection rules of your country of residence may also apply.
If you are a merchant (Kaufmann), a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for disputes is Hamburg, Germany.
